virginia divorce equitable distributionIn Virginia the Court does not have to divide marital property equally. The Court may divide the property in whatever percentage it deems to be fair and equitable. In other words, the Judge can award the husband 20% of the marital assets and the Wife 80% if s/he feels that the wife contributed significantly more than the husband or if the husband squandered marital assets.

In Virginia, marital property does not have to be titled in both parties names. If one party’s name is on the house, but both parties lived in or contributed to the household during the marriage, the Judge could order that the party whose name is not on the deed to the house still has an ownership interest in the house. Furthermore, many military spouses are under the false impression that they are automatically entitled to a percentage of their spouses military pension after ten years of service. This is not the case. DFAS will not cut a check directly to a military spouse unless that spouse has been awarded the military pension by a divorce court of Competent jurisdiction.
